Abstract: This paper aims to bring to the public's attention the way Gargantua, a versatile hero, ad-hoc asserts himself as a judge through his wisdom and tact. The wisdom of the magistrate holds a significant place in the art of judgment but is not complete without adherence to the inherent procedural principles - equity, impartiality and respect for the law. Thus, although he is a wise magistrate, Gargantua would not entirely find his place in a modern court, as his only quality as a magistrate highlighted in Rabelais's work is that of exceptional reasoning. The law and, implicitly, the procedural system have evolved to the point where we can ask today whether the key to a wise judgment is the combination of the judge's reasoning and adherence to procedural principles. Thus, the following aspects will be addressed during this paper: commentary on the scene where Gargantua is summoned by the wise to help them make the decision they have been asked for, characterization of the the character of Gargantua in a synthetic manner and the issuance of some preliminary conclusions about it. There will subsequently be a presentation in comparative light of European legislations regarding the major principles that guide the activity of judges, the targeted countries being Romania and France. This comparison will be accompanied by key jurisprudences from national laws as well as relevant jurisprudence from European courts. The introductory parts of the Codes of Civil Procedure from Romania and France will be synthetically analyzed along with the doctrine from these two countries.
