Abstract: The article will analyze the right of withdrawal of the author of the work, starting from the example illustrated in the volume “The Shadow of the Wind”, written by Carlos Ruiz Zafón. In this book, the right of withdrawal has a negative side, linking the withdrawal of the work to its destruction by the author.

Starting from the theories circulated in relation to law and literature, we want to unite the two fields. In addition, we will analyze in a comparative manner the French legal system (to which we owe the present Romanian regulation of the right of withdrawal) and the Romanian legal system.

Finally, our research will provide an overview of the right of withdrawal, its effects towards third parties and the connection with the destruction of the work.
