Abstract: The notion of „tort law” has become the generic term for several characteristics related to tortious liability in Europe, without being strictly defined. Correlating this notion with the term „delict” or non-contractual liability, we notice that we cannot place them in a relationship of total synonymy. By choosing states pertaining to different legal systems, namely Romanian and French law in the civil law system, and English law in the common law system, respectively, we aimed to examine the scope of civil liability, ascertaining the existence of notable differences. Thus, in this article we intended to carry out a comparative analysis of the regulation approaches and of the elements of the tort of negligence, focusing on the causal link between the breach of the duty of care and the damage caused, pointing out the translation and interpretation difficulties encountered when ascertaining the meaning of a legal concept that belongs to a different legal system.
