Rezumat: În prezenta lucrare ne propunem să analizăm statutul juridic al entităţilor de tip Patent Trolls, cunoscute și sub denumirea de „non-practicing entities” (NPEs), sub aspectul valorificării drepturilor conferite de brevetul de invenţie în absenţa unei exploatări efective a invenţiei propriu-zise. Cu toate că prin intermediul brevetării unei invenţii se conferă drepturi exclusive specifice, se pune problema în ce măsură utilizarea acestora în scop litigios într-o manieră sistematică, fără intenţia de a produce sau comercializa un bun, poate constitui un abuz de drept. În acest context, întrebarea firească care apare este dacă putem percepe entităţile de tip Patent Troll ca fiind un promotor al inovaţiei sau un veritabil autor al abuzului de drept. În realizarea acestui demers este relevantă interpretarea oferită de jurisprudenţa instanţelor americane, în special în cauza eBay Inc. V. MercExchange, care accentuează importanţa menţinerii unui echilibru în exercitarea drepturilor exclusive.
