Abstract: In this article, we will explore the legal meaning of the national brand's seniority concept, as regulated by Articles 39 and 40 of Regulation (EU) 2017/1001 on the European Union trade mark. To clarify its meaning, we will analyse the legal translation of this notion by referring to the official translations of the regulation’s text in various national languages of EU member states. The core focus will be the metaphorical nature of this concept, examined through the lens of legal translation, as metaphors play a crucial role in conveying many legal concepts. Accordingly, we will highlight the necessity of metaphors and their translation in the legal language to ensure the accurate representation of certain legal aspects.
