Abstract: This article analyses the case law of the Iași District Court from 1 February 2014 to 1 April 2025, with the aim of identifying the defining features of the standard of judicial reasoning applicable to extended confiscation. The research is based on an examination of the two judicial decisions delivered during this period and assesses the structure and quality of the reasoning adopted by the court of first instance in applying Article 1121 of the Romanian Criminal Code.

The first part of the article presents the context and methodology of the analysis, with particular emphasis on the specific analytical criteria applied. The second and third sections examine the identified case law by analysing the factual and legal circumstances established by the court, the penalties imposed, and the patrimonial safety measures ordered. The fourth part of the article provides a critical interpretation of the court’s reasoning regarding the legal conditions for extended confiscation, with reference to the purpose of safety measures, the offence, the assets subject to confiscation, and the offender.

Finally, the analysis highlights an uneven and insufficiently defined standard of judicial reasoning, even within the same court. The findings of the study support the proposal of minimum criteria necessary for establishing a rigorous standard of judicial reasoning for extended confiscation, in accordance with the requirements of the right to a fair trial and the protection of the right to property.
