George Claudiu Pupăzan: Critical remarks regarding the legal liability enshrined in art. 240 of the Romanian administrative code

Abstract: The Romanian Administrative Code introduced a series of regulations on liability for local public administration acts which, on closer examination, tend to amplify the degree of legal liability for civil servants involved in the preparation of the administrative decision, while reducing it for local elected officials who issue or, as the case may be, adopt this decision.One can thus speak of a transfer of legal responsibility, regulated by law, from elected officials to civil servants in the specialized apparatuses of local public administration authorities, a situation which, from our point of view, is unacceptable.
