Abstract.Although the principle pacta sunt servanda (the principle of binding force of contracts) and the principle mutuus consensus, mutuus dissensus are applicable, the parties may introduce in the pre-sale contracts/ promissory sales contract a termination clause which gives the parties the right to unilaterally terminate the contract in exchange for a sum of money. The article analyzes certain relevant aspects of the jurisprudence regarding the termination clause in a pre-sale-purchase contract.
