Abstract: Ever since ancient times, marriage is a law institution of considerable importance as far as creating legal connections between individuals is concerned, that has been recognized even as a right for everyone in various international treaties. However, what happens when this right can be affected by the differences between the law systems the states base their legislation on? The following work aims at defining the term of marriage in the Romanian legislation, discussing the conditions for solemnization and applying these notions in the comparative law systems (for example, French law, Islamic law, common law in the United Kingdom, etc.). Furthermore, the historical meaning of marriage in the Roman law is to be explored, along with the religious significance of it, by using canon law notions.
