Abstract: The judicial individualization of punishment is an institution of real importance with regard to the conduct of the entire criminal process. It is naturally and necessarily linked to the fundamental institutions of criminal law, specifically offence, criminal liability and criminal sanctions. Alongside the criminalization, it is therefore necessary to adapt the punishment within certain limits determined by the legislator, depending on the specific nature of the offence committed. The present article is structured in two parts - the first part is intended to delimit the justification from the legal aggravating circumstance of provocation, and the second part is focused on the analysis of the relationship between certain circumstances retained by the Romanian Penal Code as legal aggravating circumstances and the constituent elements of the content of certain offences regulated in the Special Part of the Criminal Code.
