Abstract: This article proposes to identify what is the position of criminal judge in different states relative to different means of expression of religious freedom, especially we consider situations related to Islamic religion followers events, but not exclusivelly.Part two of this article focuses constitutional court decisions in different countries in order to reflect different aspects of the prosecution of religious freedom. With more so as the Constitution and the criminal are closely related, and presentation of the two views reflects the logic of combining the two branches of law.Presentation and analysis of issues in the law on comparative law component, highlights the many issues raised by the need to respect religious freedom. The issues raised by the case law designed to complete doctrinal exposures as indicating the existence of situations that haven't been identified as possible untill now.
