Rezumat: Acest articol analizează caracteristicile şi implicaţiile teoretice şi practice specifice noţiunilor de ultim domiciliu sau de ultimă reşedinţă obişnuită a decedatului, în contextul Regulamentului European Succesoral nr. 650/2012. Articolul prezintă într‑o manieră analitică metodele actuale de stabilire a ultimului domiciliu sau a ultimei reşedinţe obişnuite, observând consecinţele practice din perspectiva legislaţiei internaţionale. Ca atare, în lucrare se analizează statutul juridic al ultimei reşedinţe obişnuite, ca element de legătură care permite alegerea legii aplicabile succesiunii, respectiv a jurisdicţiei. Scopul principal al lucrării implică studiul noţiunilor enumerate mai sus, în legătură cu aspectele litigioase relativ la succesiunea transfrontalieră, insistându‑se pe evaluarea avantajelor sau dezavantajelor care rezultă din utilizarea acestui element de legătură, pentru a simplifica procedura succesiunilor transfrontaliere în Uniunea Europeană şi, în consecinţă, pentru a garanta obiectivul securităţii juridice, atât pentru decedaţi, cât şi pentru moştenitori sau părţile interesate. Concentrându‑se pe dispoziţiile Regulamentului Succesoral European, articolul analizează problemele juridice rezultate prin utilizarea conceptului deschis de „acasă, atât din punctul de vedere al ideii de domiciliu, cât şi de reşedinţă obişnuită.
