Abstract: The process of establishing associations and foundations is a difficult one and is done in violation of the Romanian law which provides that associations and foundations shall be established within 3 days from the date of filing the application. This article analyses this problem and the need for a better establishment process and proposes the establishment of a legal regime similar to the Romanian Trade Register for the Register of Associations and Foundations, in order to relieve the courts of the activity of establishing associations and foundations and to increase the speed of the process of granting legal personality to associations and foundations, using an electronic platform similar to the Trade Register portal.
