Abstract: The issue preclusion has an indisputable importance for the legal certainty. This effect of judgement implies that one party can’t start again the process in order to obtain another solution of the case. In this order, law provides certain means of defence for the person to defend himself by rising the exception of issue preclusion of a judicial act.
