Abstract: The historical development of the relationship between criminal law and the Basic Law of Romania. This article presents the historical relationship between criminal law and the Constitution in Romania. It is divided into two parts: the first part examines the links between the first Criminal Code of Romania and constitutions that have followed (1866 and 1923). The second part is an analysis relationship between the Criminal Code and other Constitutions Carol II of Romania (1938, 1948, 1952, 1965).
