Abstract: The vitiated consent as a component of deceit in conventions. Abstract. The issue regarding misleading of a person using deceitful means implies that the vitiated consent must be analyzed in terms of both civil law, as a factor which can affect the validity of a contract making it voidable, and criminal law, as a component of the criminalization of deceit în conventions. When analyzing the fraudulent mis-representation one must establish whether the vitiation of consent takes place in the manner prescribed by Article 215 (3) of the Penal Code, as the legal regulation sets the limits within the vitiated consent determines the intervention of criminal law, when all constituent factors of the deceit offence are met.
