Carmen MOLDOVAN: Refugees – subjects of forced migration

Abstract: Millions of people are today forced to flee their homes as a result of conflict, systematic discrimination, or other forms of persecution. The core instruments on which they must rely to secure international protection are the 1951 Convention Relating to the Status of Refugees and its 1967 Protocol. It is not a complete protection as it is in opposition with the state sovereignty principle in migration policies. The UN system of protection is also incomplete due to the existence of other categories of migrant persons that are excluded from its protection. The regional instruments of protection are more evolved in defining the concept of refugee, but this aspect does not represent the solving of the refugee problems and does not constitute a guarantee of a more efficient protection of the forced migrant persons.
