Lucia IRINESCU: Current regulations on family relationships

Abstract: The Act 288/2007 has amended the Act 4/1956 (The Family Code). The new regulation transposes the preoccupations of Romanian legislator for linking provisions concerning the family relationships to those mentioned in the international acts. The resulting changes aim to establish an equal legal treatment between man and woman regarding the family relationships. Consequently, the minimum age required for the marriage is the same for both spouses. Regarding the relationships derived by way of paternity, by these legal changes a legal framework is designed that allows the child to establish the paternity towards the biological father.  The present study analyses all these changes, in correlation with previous reglementations, but also in correlation with the jurisprudence of The Constitutional Court and of The European Court of Human Rights.
